These Terms of Service ("Terms") are a legal agreement between you ("you") and Elemental Genius LLC ("Elemental Genius," "we," "us," "our"), governing your access to and use of Virylium, including the Lyra Solus AI companion, at virylium.com and app.virylium.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Virylium is a web-based application accessible through a standard web browser. It is not distributed through any mobile app store and requires no native installation or download. The Service includes Lyra Solus, an AI personal brand management companion, together with features for content creation, scheduling, and publishing to social platforms you connect.
These Terms also serve as the complete license agreement governing your use of the Service. Because Virylium is delivered entirely as a web application, license terms are addressed here rather than in a separate End User License Agreement.
2. Eligibility
You must be at least 18 years old to create an account and use the Service. By using the Service you represent that you meet this requirement.
3. Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. Provide accurate information when registering, keep it current, and notify us promptly of any unauthorized use.
4. License and Restrictions
Subject to these Terms, Elemental Genius grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use. You agree not to:
- Copy, modify, or create derivative works of the Service or its underlying software
- Reverse engineer, decompile, or disassemble any part of the Service, except where that restriction is prohibited by law
- Rent, lease, sell, sublicense, or otherwise transfer your access to any third party
- Use the Service to build a competing product or service
5. Subscription, Trial, and Billing
5.1 Subscription Fee. Continued access to Virylium requires a paid subscription at $29.99 per month, or as otherwise displayed at checkout. There is no free tier and no advertising.
5.2 Free Trial — No Payment Method Required. New accounts receive a 14-day free trial. No credit card or other payment method is required to begin the trial, and nothing is charged when it ends. If you do not subscribe before the trial expires, your access simply lapses — we will never auto-charge you for a trial you did not convert.
5.3 What the Trial Includes. The trial is also Lyra's learning period. During the trial Lyra drafts and proposes content for your approval but does not publish on her own. Automated and scheduled publishing become available when you convert to a paid subscription.
5.4 Billing and Renewal. Paid subscriptions begin when you complete checkout and renew automatically each month until cancelled. Payment is processed by Stripe, Inc. ("Stripe"). Elemental Genius does not collect, view, or store your full card number; Stripe handles that under its own terms and security standards.
5.5 Cancellation. You may cancel at any time in your account settings. Cancellation takes effect at the end of the current billing period and you keep access until then. We do not provide prorated refunds for partial billing periods except where required by law.
5.6 Price Changes. We may change pricing prospectively, with notice before the change takes effect on your account.
6. Connected Platforms and Publishing
6.1 Connecting Accounts. The Service can connect to Discord, X (Twitter), Bluesky, Facebook, Instagram, Threads, LinkedIn, TikTok, and Twitch. Each connection is optional, initiated by you, and authorized through that platform's own OAuth flow. You may disconnect any platform at any time.
6.2 You Remain Responsible. Content published through the Service is published under your own accounts and remains your responsibility. You must comply with each platform's terms, community guidelines, and applicable advertising and disclosure rules. We are not responsible for a platform suspending, rate-limiting, or removing your account or content.
6.3 Platform Availability. Third-party platforms change and withdraw their APIs, and their approval processes are outside our control. Features that depend on a given platform may be limited, delayed, or discontinued, and specific platform support is not guaranteed as part of your subscription.
7. Your Data and Google Drive Integration
7.1 What We Store. We store your account and operational data in our own secured Google Cloud infrastructure.
7.2 Your Lyra Memory File. With your authorization, Virylium writes a single file — lyra.soul — to your own Google Drive, containing Lyra's memory and personalization for your account. We request only the narrow drive.file OAuth scope, which limits our access to files Virylium itself creates. We cannot see or access any other file or folder in your Drive.
7.3 Your Control. Because lyra.soul lives in your Drive, it remains yours. You may revoke access at any time through your Google Account permissions or in the Service settings. Revoking access affects Lyra's memory across sessions.
7.4 Content Ownership. As between you and Elemental Genius, you retain ownership of the content you provide and of the data generated for your account, including the contents of lyra.soul. You grant us a limited license to process it solely to operate, maintain, and improve the Service for you. We do not use your content to train foundation models.
8. Account Deletion
You may delete your account and associated data at any time through your account settings, at elementalgenius.com/deleteme, or by emailing [email protected]. Deleting your account cancels any active subscription and removes your data as described in the Privacy Policy. You choose whether your lyra.soul file is also deleted from your Drive; by default we leave it, because it is yours. All information is deleted within 45 days of a verified request.
9. Lyra Solus and AI-Generated Content
Lyra Solus is an AI system. Text, captions, and images she produces are generated automatically and may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for reviewing and independently verifying any content before publishing or relying on it. You are also responsible for making any disclosure of AI-generated or AI-assisted content that a platform or applicable law requires.
Usage limits apply to computationally expensive features such as image generation, as described in the Service. We may adjust these limits with notice.
10. Acceptable Use
You agree not to use the Service to:
- Upload, generate, or publish content that is unlawful, defamatory, harassing, hateful, sexually explicit involving minors, or infringing on the rights of others
- Impersonate any person or organization, or misrepresent your affiliation
- Generate or publish content designed to deceive, including synthetic media presented as authentic
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means to access the Service outside an officially provided interface
- Violate the terms or community guidelines of any connected platform
We may suspend or terminate accounts that violate this section.
11. Third-Party Services
The Service integrates with third parties including Stripe (payments), Google (Drive, authentication, cloud infrastructure, and AI processing), and the social platforms you connect. Your use of those integrations is also subject to the relevant third party's terms and privacy policy. We are not responsible for their acts or omissions.
12. Intellectual Property
The Service — including its software, design, branding, and the Lyra Solus character and likeness — is owned by Elemental Genius LLC and protected by intellectual property law. Nothing in these Terms grants you a right to use our trademarks, logos, or branding without prior written consent.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEMENTAL GENIUS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Elemental Genius LLC from any claim or demand, including reasonable legal fees, arising out of content you publish through the Service, your violation of these Terms, or your violation of the rights of a third party or the terms of a connected platform.
16. Termination
We may suspend or terminate your access for violation of these Terms, non-payment, or as required by law. On termination your right to use the Service ceases immediately, though provisions that by their nature should survive — including Sections 4, 12, 13, 14, and 15 — continue to apply.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Monroe County, New York, and you consent to the personal jurisdiction of those courts.

18. Changes to These Terms
We may update these Terms from time to time. If we make material changes we will provide notice before they take effect. Continued use after that constitutes acceptance of the revised Terms.
